$2.4 Million for Physical Therapist in Arizona

After suffering injuries falling off of a horse in the Arizona desert, a physical therapist filed a disability claim. She had run a physical therapy practice in Connecticut, and was in the process of moving to Arizona at the time of her injury.

The insurer refused to pay the claim, asserting that she was no longer a physical therapist. The disability insurer also questioned the nature and extent of the injuries.

Our Arizona disability lawyer vigorously pursued a lawsuit. We convinced the court to apply Arizona law, which allows for punishment of insurers for bad faith conduct in handling claims. We fully investigated the medical aspects of the claim, questioned the insurer under oath and exposed weaknesses in their positions, and obtained a settlement after an extensive mediation process.

The value of the resolution exceeds $2.4 million. Hundreds of thousands were paid at time of settlement, and a stipulation was entered into requiring ongoing payments for the rest of the client’s life.
