In May 2011, Evan Schwartz and Bill O’Mahony were featured speakers at the New York State Bar Association’s Torts, Insurance and Compensation Law Section CLE presentation concerning the handling of no-fault cases in New York. The presentation addressed new legal developments, New York’s serious injury threshold, and coverage issues. Schwartz and O’Mahony discussed the legal and practical implications of the Mallela case, which addressed the ownership of medical practices that submit billing in the no-fault system and the insurance regulation. They also updated the audience on the law and litigation tactics and strategies in non-fault fraud cases brought in both state and federal courts in New York.
