The conference is hosted by the American Conference Institute and this year’s forum is the 10th annual event. Speakers at these events are drawn from the nations’ top law firms that litigate disability law issues. Partners and attorneys of our firm have been invited to lecture in each of the last 4 years.
This year, our presentation is entitled “Claims and Lawsuits by Insurers for Benefits Paid When Fraud is Alleged.” We have has successfully handled numerous claims where fraud was alleged by a disability insurer. In one high profile case, we obtained the stunning result of having a judge throw out an improper criminal conviction of an innocent client and then he obtained a large settlement on the client’s claim from the disability insurer. In another case, after we obtained a jury verdict in favor of the client, a prosecutor was convinced to close his investigation and disband a grand jury that was considering an indictment.
Many insurers have begun to use the technique of asserting a fraud allegation and suing a disabled claimant for a refund of benefits already paid. In addition to this strong-arm tactic, some insurers have used criminal prosecutors as a tool to advance their financial interests.
